Terms and Conditions and Release Waiver
Payment of your down payment and/or workshop registration fee confirms that you agree with the following Terms and Conditions:
Reservation and Payment
We accept payment of your reservation via personal checks and credit card.
Release of Liability
Participants sign up and payment of workshop fee serves as a release of our liability and complete assumption of all risks.
Health: Participants should be in generally good health. Any medical issues should be made known to us well before the workshop. Obtain your physicians approval before participating in any activities that he/she has previously recommended against. Participants are expected to be in good enough health to be able to walk at least a mile over uneven terrain, walk at higher elevations, move around and drive at night to various locations during the workshop. Carpools are often organized among participants but are not required or recommended by your hosts. Each individual evaluates the risk (Covid, etc) and makes their own decision.
By registering and submitting a payment to Great Basin School of Photography, the participant understands that participating in this event is potentially hazardous, and that they should not enter and participate unless participant is medically and physically able to walk over a mile on uneven terrain. In consideration of the attendance at this workshop you, the participant, assume full and complete responsibility for any injury, accident or loss of property which may occur while traveling to or from the event, during the event, or while on the location during the event. Participant is also aware of and assumes all risks associated with participating in this event, including but not limited to falls, contact with other participants, effect of weather, traffic, and conditions of the road. Participant further understands that these outdoor courses present inherent risks of personal injury or sickness, injury by falling rocks, getting lost, traveling in rough terrain, possible creek crossings, wild and stock animals including horses and cattle, forces of nature such as lightning strikes, absence of prompt medical attention if needed, inadequately marked trails, hiking injuries, illness due to altitude, and travel by automobile or other conveyance. Participant, for him/her/self and heirs and executors, hereby waive, release and forever discharge the event organizers, sponsors, promoters, Great Basin School of Photography and each of its agents, representatives, successors and assigns, and all other persons associated with the event, all liabilities, claims, actions, or damages that participant may have against them arising out of or in any way connected with my participation in this event. Participant understands that this waiver includes any claims, whether caused by negligence, the action or inaction of any of the above parties, or otherwise. The participant acknowledges that Great Basin School of Photography neither insures workshop participants nor provides insurance covering any injury, health care problem, property loss or other need during the workshop. Travel and cancellation insurance is the sole responsibility of the participant. Great Basin School of Photography, its principals, employees, agents, heirs and assignees, shall not be liable for any injury, loss, or damage arising out of or in connection with participation in any workshop, including, without limitation, injury to person or property, or consequential or incidental damages, whether caused by acts, errors or omissions of instructors or staff, tour guides, outfitters or other providers associated with the workshop.
Clarity
During the workshop there will be many concepts and procedures that we cover throughout our time together. Understanding a particular concept may be a prerequisite to understanding later material, so if something is not clear to you, it is critical that you communicate that to us immediately. If you would like additional information or assistance, we appreciate your speaking up at the time so that we can better understand your needs and expectations and can address this within the course of the workshop.
Travel Insurance Is Strongly Advised
Travel insurance covers a number of unforeseen events such as airline flight issues, injury or illness, that may prevent you from attending the workshop. If we’ll be in a remote area, many policies cover accidents and evacuation. Forbes has an article on travel insurance with companies ranked beneath. Trip cancellation coverage is a useful feature, but as they point out for basic policies, “Keep in mind, trip cancellation insurance only pays for problems listed in the policy. It won’t cover changing your mind or foreseeable events, such as a pandemic that was already known.” To have the option to cancel for any reason at your discretion, adding “Cancel for any reason” coverage gives you maximum flexibility and control. That added flexibility is particularly useful since the arrival of the pandemic. Postponement/Interruption due to unforeseen events
Great Basin School of Photography shall not be held responsible for occurrences that are beyond its control that may make the workshop impossible or inadvisable to hold as planned. In the event a workshop cannot be held on the original dates, rescheduling it may become necessary. If the rescheduled dates do not work for the participant, similar dollar credit may be transferred to another workshop for up to 18 months from the original workshop date. If a workshop must be halted while underway, workshop participants will receive a credit to be applied towards a future workshop that is equal to $150 per day that the workshop was unable to be continued. The credit will be the limit of Great Basin School of Photography liability. The workshop provider will not be responsible for any expenses incurred by participants in preparing to attend the workshop including non-refundable or penalty-carrying airline tickets, special equipment, or other workshop related expenses (see Travel Insurance Is Advised).
Cancellation Policy
Your workshop fee pays for all of the work that we do to conduct a workshop, the vast majority of which occurs before the workshop dates. We scout locations for years, get to know peak seasonal timing, identify compositions and routes, daily and workshop itineraries. We apply for and maintain permits and insurance. We buy and maintain camera gear and software. As professional photographers and workshop leaders, our vehicles are purchased and maintained through our work. If you cancel or change, the work for the original workshop was done. Although we often have the flexibility to transfer credit, it’s a fictitious amount: we’re not a bank, and we prepped for the original workshop as we committed to do. This is why most of our competitors have a 180-day cancellation policy or a strict “no cancellation” policy, with travel insurance your only recourse. Any rescheduled workshop dates are additional work, time and expense to us, tips are gratefully accepted!
If you need to cancel, the cancellation must be sent to us by email at info@JeffSullivanPhotography.com . Should you need to cancel, the following fees apply:
- For cancellations more than 90 days from departure, we will offer 50% of the workshop fee as a credit that can be applied to a future workshop starting within 365 days of the original workshop date.
- No cancellations within 90 days; purchase travel insurance to handle unforeseen events or to be able to cancel for any reason, at your discretion.
- Changes or cancellations will incur a $150 fee per event.
- We highly recommend a travel insurance policy which includes coverage for cancellations for any reason (see Travel Insurance Is Advised.)
Flexibility
Great Basin School of Photography reserves the right to make changes to itineraries so as to take advantage of the best photographic opportunities or if local conditions dictate, such as changes for photographic opportunity or safety reasons. Weather and shooting conditions are beyond our control.
Additionally, Great Basin School of Photography LLC reserves the right to change the terms of our policies at any time without notice.
Governing Law
Our workshops are operated by Great Basin School of Photography, LLC, and our agreement to provide services to you is governed by the laws of the state of Nevada.
Exclusivity
We’ve invested many years of time and large amounts of money to discover our shooting locations. The sites we choose, itineraries we connect them in, our techniques and our customer communications are intellectual property we’ve developed over time. Workshop participants agree not to organize, host, promote or sell photo workshops/trips/tours to locations they have visited with Great Basin School of Photography within 5 years of attending a workshop. In case of violation, a licensing fee of $10,000 USD per year is applicable.
